Terms of Use for gShare

1. Scope
These Terms of Use apply to the use of the service “gShare”.
gShare is an online service that allows users to upload files and create download links for them. These links can be shared with other people so that they can download the provided files.
The service may be used by both private and business users.

3. Description of the Service
gShare allows users to upload files and create download links.
Depending on the type of use, links may be limited by time, number of downloads, or other restrictions. Files are not stored permanently, but are automatically deleted depending on the active links and their usage.
There is no claim to permanent storage, archiving, or restoration of uploaded files.
4. Use as Guest and with User Account
gShare can be used as a guest or with a user account.
Guest users may currently upload a maximum of one file per day. For guest users, the current upload limit is 500 MB per file. In addition, the total amount of all guest uploads is currently limited to 5 GB per day.
These limits may be adjusted if necessary. There is no entitlement to permanently unchanged limits.
Registered users currently have no fixed upload or usage restrictions unless otherwise stated on the website. Technical, organizational, or security-related restrictions may also be introduced for registered users.
5. Costs
gShare may offer free and paid features.
The service is currently in a phase in which paid features may be added later. Paid services will only be charged if users are informed in advance and explicitly select or book these services.
6. User Obligations
Users are responsible for the files they upload, the links they create, and the people with whom they share those links.
Users agree not to misuse gShare. In particular, it is prohibited to upload, store, share, or make available files that:
- violate applicable law
- infringe third-party rights
- contain copyrighted content without authorization
- contain malware, viruses, trojans, or other harmful code
- serve fraudulent, deceptive, or abusive purposes
- contain unlawful violence, abuse, or exploitation material
- contain personal data for which there is no authorization to process or share it
- contain trade secrets or confidential third-party information without permission
- support spam, phishing, or other unwanted communication
7. Responsibility for Content
The respective users are solely responsible for uploaded files and shared content.
gShare merely provides the technical option to upload files and make them available via links. gShare does not adopt user-uploaded content as its own.
Users and guests are themselves liable for the files they upload, the links they create, and the sharing of those links.
8. File Scanning and Reporting Violations
gShare may automatically scan uploaded files for viruses, malware, or other technical security risks.
A general content review of files does not take place. In particular, files are not routinely checked manually for their content.
Violations of these Terms of Use, illegal content, or abusive use may be reported to:

After receiving a report, gShare may review, block, or delete the affected content and restrict or deactivate user accounts where necessary and appropriate.
9. Download Links and Deletion of Files
Uploaded files are stored only for as long as necessary to provide active download links.
A file will be deleted in particular when:
- all links associated with the file have been used up
- all permitted downloads have been accessed
- all links to the file have expired
- there are no active links to the file anymore
- the user deletes the file themselves
- gShare removes the file due to misuse, security risks, or legal violations
After deletion, the file is permanently removed. Restoration is not possible.
Users should therefore not upload files unless they have stored them elsewhere. gShare is not a backup service.
10. Availability of the Service
gShare strives to provide stable and reliable operation of the service.
However, uninterrupted availability is not guaranteed. The service may be temporarily restricted or unavailable, in particular due to maintenance, technical faults, security measures, overload, or force majeure.
gShare may modify, expand, restrict, or discontinue functions where this is necessary for technical, economic, legal, or security-related reasons.
11. Blocking and Deletion in Case of Misuse
gShare may block, delete, or restrict uploads, links, files, or user accounts if there are indications of misuse, illegal content, security risks, or violations of these Terms of Use.
This applies in particular in cases of:
- distribution of malware
- illegal content
- copyright infringement
- phishing or fraud attempts
- circumvention of technical restrictions
- excessive or automated use
- attacks on the service infrastructure
12. User Accounts
If users create a user account, they are required to keep their login credentials confidential and protect them from access by third parties.
Users are responsible for all activities carried out through their user account, insofar as they are responsible for them.
If misuse or unauthorized access is suspected, gShare should be contacted immediately.
13. Data Protection
Information on the processing of personal data can be found in gShare’s Privacy Policy.
The Privacy Policy is available separately from these Terms of Use.
14. Liability
gShare is fully liable in cases of intent and gross negligence as well as in cases of injury to life, body, or health.
In all other respects, gShare is liable only in accordance with statutory provisions.
Users are responsible for their files, their legality, their sharing, and their backup.
gShare assumes no liability for the loss of uploaded files insofar as the loss is caused by the intended deletion mechanism, expired links, used-up downloads, user behavior, or technical circumstances for which gShare is not responsible under statutory provisions.
15. Changes to These Terms of Use
gShare may amend these Terms of Use if this is necessary due to technical changes, new features, legal requirements, or economic adjustments.
Registered users may be informed of changes in an appropriate manner. If the service continues to be used after amended terms take effect, the amended terms shall apply to the extent legally permissible.
16. Applicable Law and Place of Jurisdiction
The law of the Federal Republic of Germany applies, unless mandatory statutory consumer protection provisions conflict with this.
The place of jurisdiction is, to the extent legally permissible, the registered office of the provider.
Statutory consumer rights remain unaffected.
17. Final Provisions
Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
The statutory provisions shall apply in place of the invalid provision.
